Terms of Service

These Terms of Service ("Terms") govern your use of the CatchLead service provided by CatchLead Ltd, a company registered in England and Wales under company number 17079928("CatchLead", "we", "us", "our"). By creating an account or using our Service, you agree to these Terms.
1. The Service
CatchLead provides an AI-powered WhatsApp assistant for UK tradespeople. The Service responds to inbound customer WhatsApp messages on your behalf, qualifies leads, provides rough price estimates based on your configuration, and helps book calendar appointments.
The Service is designed as an assistant, not a replacement for professional judgment. You remain responsible for all customer relationships, pricing decisions, and work carried out.
2. Eligibility
- You must be at least 18 years old
- You must be a UK-based tradesperson or trade business
- You must have a valid WhatsApp Business account or be willing to set one up
- You must provide accurate information during registration
3. Your Account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@catchlead.ai if you become aware of any unauthorised access.
You may have only one active CatchLead account per WhatsApp Business number.
4. Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, the AI assistant will stop responding to messages on your behalf.
5. Subscription and Payment
5.1 Pricing
Current pricing is available on our website at catchlead.ai. Prices are in British Pounds (GBP) and include VAT where applicable. We reserve the right to change pricing with 30 days' notice to existing subscribers.
5.2 Billing
Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. Failed payments may result in temporary suspension of the Service.
5.3 Cancellation
You may cancel your subscription at any time via the dashboard or by contacting support@catchlead.ai. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months, except as required by UK consumer law.
5.4 Refunds
If you are a consumer and are not satisfied with the Service, you may request a full refund within 14 days of your first paid subscription, in accordance with the Consumer Contracts Regulations 2013. Contact support@catchlead.ai to request a refund.
6. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or marketing communications to your customers
- Provide misleading or fraudulent information about your services or pricing
- Process data in violation of UK GDPR or other applicable data protection laws
- Engage in any activity that violates WhatsApp's Terms of Service or Commerce Policy
- Interfere with or disrupt the Service or its infrastructure
- Resell, sublicense, or provide access to the Service to third parties
- Use the Service for any trade or service that is illegal in the United Kingdom
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
7. AI-Generated Responses
7.1 Nature of Responses
CatchLead uses artificial intelligence to generate responses to customer messages. While we strive for accuracy and professionalism, AI-generated responses:
- Are based on the information you provide during setup (trade type, price ranges, services)
- Provide rough price ranges only, never fixed quotes or commitments
- Do not constitute professional advice, technical diagnoses, or binding offers
- May occasionally be inaccurate or inappropriate despite our safeguards
7.2 Your Responsibility
You are responsible for the accuracy of the information you provide to configure the Service (price ranges, services offered, coverage area). You should regularly review the conversations CatchLead handles on your behalf via the dashboard to ensure quality.
You acknowledge that CatchLead acts as your agent when communicating with customers, and you are responsible for honouring reasonable expectations set during AI-handled conversations.
7.3 Human Handoff
CatchLead always offers customers the option to speak directly with you. When a customer requests this, or when CatchLead encounters a situation it cannot handle, it will alert you and step back. You should respond to these handoff requests promptly.
8. Data Processing Agreement
This section constitutes the Data Processing Agreement (DPA) between you (the data controller) and CatchLead (the data processor) for the processing of your end customers' personal data.
8.1 Scope of Processing
We process end customer personal data solely for the purpose of providing the Service, including:
- Receiving and responding to WhatsApp messages
- Qualifying leads and extracting job details
- Providing price estimates based on your configuration
- Booking calendar appointments
- Sending daily summary reports to you
8.2 Our Obligations
As data processor, we will:
- Process personal data only on your documented instructions
- Ensure all personnel with access to personal data are bound by confidentiality obligations
- Implement appropriate technical and organisational security measures
- Not engage sub-processors without your prior authorisation (sub-processors are listed in our Privacy Policy)
- Assist you in responding to data subject requests (access, deletion, portability)
- Delete or return all personal data upon termination of the Service, at your choice
- Make available information necessary to demonstrate compliance with GDPR obligations
8.3 Your Obligations
As data controller, you are responsible for:
- Having a lawful basis for collecting and processing your customers' data
- Informing your customers that you use an AI assistant to handle initial enquiries
- Responding to data subject requests from your customers (we will assist)
- Ensuring the accuracy of the data you provide to configure the Service
9. Intellectual Property
CatchLead, including its software, branding, design, and AI systems, is our intellectual property. Your subscription grants you a non-exclusive, non-transferable licence to use the Service for your business during the subscription period.
You retain ownership of all data you provide, including your business information, price configurations, and customer conversation history.
10. Service Availability
We aim to provide 99.9% uptime for the Service. However, we do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance where possible.
The Service depends on third-party platforms (Meta WhatsApp API, Anthropic AI). We are not responsible for outages or changes to these third-party services, but we maintain fallback mechanisms to minimise disruption.
11. Limitation of Liability
To the maximum extent permitted by law:
- CatchLead's total liability to you in any 12-month period shall not exceed the total fees you paid to us during that period
- We are not liable for any indirect, incidental, consequential, or special damages, including lost profits, lost business, or missed opportunities
- We are not liable for the accuracy of AI-generated responses or for any decisions made based on those responses
- We are not liable for the actions or omissions of third-party services (Meta, Anthropic, Google, Stripe)
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by English law.
12. Indemnification
You agree to indemnify and hold CatchLead harmless from any claims, damages, or expenses arising from: (a) your use of the Service; (b) inaccurate information you provide; (c) your breach of these Terms; or (d) your violation of any applicable law or third-party rights.
13. Termination
Either party may terminate this agreement at any time. You may cancel your subscription via the dashboard. We may terminate or suspend your account if you breach these Terms, with notice where practicable.
Upon termination, you may request export of your data within 30 days. After 30 days, we will delete your data in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect, via email or WhatsApp. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you retain any mandatory consumer protection rights granted by the laws of your country of residence.
